Privacy Policy regarding the processing of personal data

e-moove is the commercial name of SC E-MOOVE VEHICLES SRL, a legal entity of Romanian nationality, with its registered office in Bucharest, Str. Capt. Ion Gârbea 26, sect. 5 et. 11-12, Ap. 119, with order number in the Trade Register J40/14506/2019, unique tax registration code RO41819402 (hereinafter "e-moove" or "us").

Because we want to always be in contact with you, as well as to provide you with any additional information you may need regarding the processing of your data, we invite you to contact us through the Integrated Messaging in our website www.e -moove.ro, or write to us at contact@e-moove.ro.

Ensuring the right to the protection of personal data is a fundamental e-moove commitment, therefore we will dedicate all the necessary resources and efforts to process personal data in full compliance with Regulation (EU) 2016/679 ("General Data Protection Regulation ” or “GDPR”), as well as with the legislation applicable on the territory of Romania, respectively by complying with the requirements of law no. 67/2001 for the protection of individuals regarding the processing of personal data and the free circulation of such data, amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector This Privacy Policy is made in accordance with Regulation (EU) 2016/679 ("General Data Protection Regulation" or "GDPR"), as well as with the requirements of Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free circulation of these data, amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector.

The purpose of collecting personal data is to create an account on the website www.e-moove.ro, in the e-moove application and to confirm the identity of the ("User"):

For marketing:

Marketing communications will only be made with the prior consent of the Customer.

We will offer in each Customer's account the option to unsubscribe from commercial communications.

To defend the legitimate interests of the company:

Measures to prevent and detect fraud attempts, including the transmission of information to the competent public authorities;

Measures to manage various other risks.

The general basis of these types of processing is the legitimate interest of the Company to defend its commercial activity, it being understood that it ensures to take all measures that guarantee a balance between the interests of the Company and the fundamental rights and freedoms of the Client.

Also, in certain cases, the Company bases its processing on legal provisions such as the obligation to ensure the protection of goods and valuables provided by the applicable legislation in this matter.

We do not collect or otherwise process sensitive data, included by the General Data Protection Regulation in special categories of personal data.

Following the development of the contract, we can process certain information regarding the Customer's behaviour, with the aim of customizing the offers to him as best as possible and improving our services.

How long do we keep your personal data?

We store your data as long as you have an account in the e-moove app and website.

You can request us to delete certain information or delete your account at any time. We will comply with these requests, subject to the retention of certain information including after the account is closed, in situations where applicable law or our legitimate interests require it.

To whom do we transmit the Customer's personal data?

Where do we store data?

Currently, the Company stores the Customer's personal data on a server belonging to a supplier in Romania.

Transfers to service providers and other third parties will always be protected by contractual commitments and, as the case may be, by other guarantees, such as standard contractual clauses issued by the European Commission and Romanian state legislation.

How long does it take to get back to you?

We will do our best to answer you as quickly as possible, but when the request is complicated, we promise to answer within a month at most.

Ways to protect the security of the Client's personal data

Bank card payments are made through an authorized payment processor registered in Romania. All payment information is encrypted and stored by the payment processor.

The website www.e-move.ro is encrypted with an HTTPS certificate. Security issues related to the vulnerabilities of the network and the Internet provider used by the customer are the sole responsibility of the customer. E-moove cannot be responsible for such vulnerabilities of systems that are not under the Company's direct control.

Customer Rights

The right to withdraw at any time a given consent in order to stop a data processing that is based on your consent. The withdrawal will not affect the legality of the processing based on the consent granted before the withdrawal, for the execution of a contract, in order to fulfil a legal obligation or for the purpose the pursuit of our legitimate interests.

The right of access - means that you have the right to obtain a confirmation from us as to whether or not we are processing the personal data concerning you and, if so, you have access to the respective data and to the information regarding the manner in which these data are processed.

The right to data portability - refers to the right to receive personal data in a structured format, currently used by us and which can be read automatically, but also to the right for these data to be transmitted directly to another operator, if this is technically feasible.

The right to opposition - refers to your right to oppose the processing of personal data when the processing is necessary for the performance of a task that serves a public interest or when it considers a legitimate interest of the operator. When the processing of personal data is aimed at direct marketing or processing based on express consent, you have the right to oppose the processing at any time.

The right to rectification - refers to the correction, without undue delay, of inaccurate personal data. The rectification will be communicated to each recipient to whom the data were sent, unless this proves impossible or involves disproportionate efforts.

The right to data deletion ("the right to be forgotten") - you have the right to request the deletion of personal data, without undue delay, if one of the following reasons applies: they are no longer necessary to fulfill the purposes for which they are were collected or processed; you withdraw your consent and there is no other legal basis for processing; you oppose the processing and there are no other legitimate reasons that prevail; personal data were processed illegally; personal data must be deleted to comply with a legal obligation; personal data were collected in connection with the provision of information society services.

The right to restrict processing - can be exercised if the person disputes the accuracy of the data, for a period necessary to verify the correctness of the data; the processing is illegal, and you oppose the deletion of personal data, requesting the restriction instead; in case the Company no longer needs the personal data for the purpose of processing, but the person requests them for ascertaining, exercising or defending a right in court; if the person has objected to the processing for the time interval in which it is checked whether the legitimate rights of the operator prevail over those of the respective person.

The right to submit a complaint - complaints regarding the processing of personal data can be addressed to the National Authority for the Supervision of the Processing of Personal Data. To exercise these rights, as well as for any additional questions regarding this information or regarding the Company's use of personal data, please contact our data protection officer, choosing any of the communication methods described.

To maintain the website www.e-moove.ro and to ensure its proper functionality, the Company uses the technology generally known as "cookies", temporary or permanent files, which can help the Customer search and find relevant results for it.

• Functional cookies: help to improve the experience by remembering the customer's choices.

• Performance cookies: to measure the way customers navigate the Company's website and to measure its performance.

• Re-targeting cookies: to help the Company place advertisements on other web pages that the customer visits, or to avoid placing advertisements for a customer who is already familiar with the Company's services.

• Social media plug-ins: to connect the Customer to social media channels. The cookies stored on the Customer's computer can be accessed when they visit the Company's website or open an email that the Company sends to the Customer. The customer can delete the cookies that are already in his computer by consulting the browser instructions.

The company processes cookies only with the Customer's consent. To withdraw consent or agree to the use of cookies, he can make the appropriate settings in his browser. Some of the features of the Company's website cannot function without cookies.

By requesting this agreement, the Company will present the purpose for which this type of information about the Customer will be processed and will inform him of his rights.

Entry into force and modification of the Privacy Policy

This Privacy Policy will enter into force on 01.07.2022.

The Company may revise the Privacy Policy and will notify the Client of any updates on the www.e-moove.ro website.
